These Terms of Service (“Terms”) govern your use of usa250bulk.com and any transactions with USA250Bulk. By using our site or placing an order, you agree to these Terms.

1. Services

USA250Bulk is an independent wholesale merchandise sourcing service. We facilitate bulk orders of patriotic and America 250th anniversary-themed merchandise from international manufacturers. We are NOT affiliated with, endorsed by, or an official partner of America250.org or any official America 250 organization.

2. Orders and Quotes

• All quotes are estimates valid for 7 days unless otherwise stated
• Orders are confirmed only upon receipt of a signed purchase order and deposit payment
• Minimum order quantities (MOQ) apply per product category
• Prices are subject to change due to material costs and foreign exchange rates
• We reserve the right to decline any order at our discretion

3. Payment Terms

• Orders require a 30–50% deposit at time of order confirmation
• Balance is due prior to shipment departure from origin country
• Payment methods: Wire transfer, ACH, credit card (3% fee)
• Late payments may delay production and shipment

4. Production and Delivery

• Production timelines begin after deposit is received and artwork is approved
• Delivery dates are estimates and may vary due to production delays, shipping delays, or customs clearance
• We are not responsible for delays caused by natural disasters, strikes, customs, or other force majeure events
• Risk of loss transfers to buyer upon handover to freight carrier

5. Product Quality and Returns

• We guarantee products match approved samples or specifications
• Claims for defective merchandise must be submitted within 14 days of delivery with photographic evidence
• Returns are accepted only for manufacturing defects, not for change of mind
• Custom-produced merchandise with approved artwork cannot be returned for any reason other than manufacturing defect
• Our liability is limited to replacement or refund of defective items

6. Intellectual Property and Licensing

Important: “America250” and the America250 logo are trademarks of America250.org Inc. USA250Bulk is an independent wholesale source and is NOT affiliated with or licensed by America250.org.

• We offer products with non-trademarked patriotic designs (e.g., flags, stars, 1776-2026)
• Buyers are solely responsible for ensuring their use of merchandise complies with all applicable trademark and licensing laws
• We do not produce or sell items bearing licensed America250™ logos or designs without proper authorization
• Customers who provide their own artwork for custom merchandise warrant that they have rights to use such artwork

7. Import Duties and Taxes

For direct imports, the buyer is responsible for all import duties, customs fees, and taxes imposed by US Customs and Border Protection. We provide all necessary documentation (commercial invoices, packing lists, certificates of origin) but do not pay these fees on behalf of buyers.

8. Limitation of Liability

USA250Bulk’s total liability for any claim arising from a transaction shall not exceed the total amount paid for the disputed order. We are not liable for indirect, consequential, or punitive damages, including lost profits, lost revenue, or event cancellation costs.

9. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
